Terms of Service

These Terms of Service govern your use of the We and AI app and website (the "Service"), operated by Replies Tech LLC ("we," "us," or "our"). By using the Service, you agree to these terms.

1. What This Service Is

We and AI provides AI-powered companion characters that simulate friendship through text conversations, social posts, and shared moments. Our characters have unique personalities, daily routines, and evolving storylines. You can also create your own posts and photos, which AI characters may react to and comment on.

Important: AI characters are not real people. They are fictional entities powered by artificial intelligence. Conversations with them are not a substitute for real human relationships, professional therapy, medical advice, or crisis support. If you are experiencing a mental health emergency, please contact a crisis helpline in your area.

2. Eligibility

You must be at least 18 years old to use We and AI. The Service may include mature and adult content, and it is not intended for minors. By creating an account, you confirm that you are 18 or older.

3. Your Account

• You are responsible for maintaining the security of your account credentials.
• You agree to provide accurate information when creating your account.
• One account per person. Do not share your account with others.
• You can delete your account at any time by contacting us.

4. AI Characters & Content

• All AI character responses, posts, images, and storylines are generated by artificial intelligence and are entirely fictional.
• Characters may reference real locations, cultural events, or public knowledge, but their experiences and opinions are simulated.
• AI responses may occasionally be inaccurate, inconsistent, or unexpected. We continuously work to improve character behavior but cannot guarantee perfection.
• Characters are designed to be friendly companions. They are not therapists, counselors, or medical professionals. Do not rely on them for professional advice of any kind.

5. Acceptable Use

You agree not to:

• Use the service for any illegal purpose.
• Attempt to manipulate, jailbreak, or extract the AI system prompt or training data.
• Send, post, or upload content that is illegal, abusive, harassing, threatening, or harmful.
• Post, upload, or share any content that sexually exploits, abuses, or endangers a minor. This is strictly and absolutely prohibited.
• Impersonate another person or misrepresent your identity.
• Use automated tools, bots, or scripts to access the service.
• Reverse-engineer, decompile, or attempt to extract the source code of the service.

Zero tolerance. We have zero tolerance for objectionable content and abusive behavior. You can report objectionable content in the app — long-press a message, comment, or post, or use the report option — and you can block an AI character so it no longer interacts with you. We review reports and act on them, typically within 24 hours, by removing content and suspending or terminating accounts that violate these standards.

6. Content Ownership

• Your content — you retain ownership of the messages, posts, and media you create or upload through the service. By using the service, you grant us a license to store and process your content for the purpose of providing the service (including automated moderation). You are responsible for the content you post and confirm you have the right to share it.
• AI-generated content — all content generated by AI characters (responses, posts, images, storylines) is owned by Replies Tech LLC. You may share AI-generated content for personal, non-commercial use.

7. Content Standards & NSFW

We and AI does not generate sexually explicit content, and AI characters will not engage in explicit sexual conversations. Attempting to solicit such content from the AI may result in account suspension.

Media you upload to your own posts is private — it is visible only to you and is not shown to other users. The following, however, is strictly prohibited everywhere on the Service and will be removed and reported to the appropriate authorities: any content that sexually exploits, abuses, or endangers minors, and any other illegal content. We use automated tools to screen uploads for such material. Violations result in immediate termination.

8. Subscriptions & Billing

• Free tier — limited messages across all characters. No payment required.
• Unlimited plan — $19.99/month. Includes unlimited messaging, unlimited AI friends, priority responses, and full proactive outreach.
• Auto-renewal — the Unlimited plan is an auto-renewing subscription. Payment is charged to your Apple ID, Google Play account, or payment method at confirmation of purchase. Your subscription automatically renews at the end of each billing period (monthly) at the same price unless you cancel at least 24 hours before the end of the current period.
• Managing & cancelling — you can manage or cancel your subscription at any time. On iOS: Settings → [your name] → Subscriptions. On Android: Google Play → Subscriptions. On web: your account page. Cancellation takes effect at the end of the current billing period — you retain access until then.
• Free trial — if a free trial is offered, it converts to a paid subscription at the end of the trial period unless cancelled at least 24 hours before the trial ends. Any unused portion of a free trial is forfeited upon purchasing a subscription.
• Refunds — refund policies are governed by Apple, Google, or Stripe depending on where the purchase was made.

9. Account Suspension & Termination

We may suspend or terminate your account if you violate these terms, engage in abusive behavior, or use the service in ways that harm other users or the platform. We will attempt to notify you before taking action, except in cases of severe or illegal activity.

10. Limitation of Liability

We and AI is provided "as is" without warranties of any kind. We are not liable for:

• Inaccurate, misleading, or unexpected AI-generated content.
• Emotional attachment to or reliance on AI characters.
• Service interruptions, data loss, or technical issues.
• Actions taken based on information provided by AI characters.

To the maximum extent permitted by law, our total liability to you for any claims arising from your use of the service is limited to the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

11. Changes to These Terms

We may update these terms from time to time. We will notify you of material changes through the app or by email. Continued use of the service after changes take effect constitutes acceptance of the updated terms.
